the unexpected The Unexpected by It was a Saturday morning, and I thought it would be a good time to go to the beach with my friends since I had nothing to do for the rest of the week. So I decided to call my best friend Sarah to see if she wanted to drive with me down to the beach Unfortunately, she had a wedding to go to, so she was not able to make it. I was a little disappointed, but I decided to go to the beach by myself. I left home at 3:30 p.m. and arrived at 5:00 p.m. to the beach house. Everything looked the same wa as it did last summer when I came with my sister. The only difference was now I was alone, and that was little scary. The next morning I went to one of my favorite cafes The Italian Coffee. This Cafe held good memories since last summer I worked there. The owners Mr. Roger and Mrs. Roger told me that a job was available if I wanted to work. I thanked them, but e lained that I had other plans for the summer. I told them that the restaurant looked great since it had been renovate d. It was very noisy and crowded, yet it had a wonderful atmosphere that customers like. Perhaps, it was the Italian music and the w derful smell of fresh coffee that attracted them. Suddenly a lady came over to my table and asked, '' How are you, Raquel?'' I told her, '' I'm sorry Maam I don't recognize you!. She replied, ''Oooh, Raquel , I'm Elizabeth's aunt''. I said, ''Of course, excuse me''. We started talking about h the place was crowded, and she told me that she had to meet a friend here, but she had not shown up. I told her that it was nice seeing here, but I was expecting a call and I had to go. She promised me she was going to tell Elizabeth to call me so w could get together for lunch soon. When I got home to check the answering machine, the telephone rang. It was mom. She said that Sarah was planning to come Monday, and if I needed anything to give her a call. I thanked her and said,'' You are not going to believe where I just came fr ?. She quickly replied, ''Don't eve n ask it '' The Italian Coffee''. '' You are right '' I giggled. '' The Rogers are doing great, working like crazy trying to make everything perfect '', I added. She said, '' Honey, I'll give you a call Friday n ht OK!. Good bye!''. So far my day was going great. I sat down and watched MTV. It was a re-run of '' The Real World''. I quickly fell asleep on the couch for two hours and was awakened by the door bell. It was Claudia Roger explaining that her mother had told her that was in town, so she decided to drop by. I told her , '' I'm glad you came by. Are you doing anything for lunch?''. When Claudia told me that she was available, we decided to go to the Dixie to get a cheese burger. On the way to the Dixie , we made a quick stoop by the shoe store to ask Mr. Edwards to tell his daughter that I was going to meet her at 5 o'clock so we could play volley ball with my friends. Mr. Edwards was concerned because he had eard rumors about a kidnapper in town. Since Elizabeth and I were running late , we didn't really pay munch attention to what he was saying. When we got home, Claudia left to go to work. Feeling in the mood for going to the beach, I packed all my th gs and drove there. By giving instruction the traditional way, the student will be able to ask question if he or she doesnt understand the lesson. The pupil will also learn by seeing the instructor actually do the work right in front of him or her. He will know what steps to take since the teacher will be explaining the process of the work step by step. The bad thing about giving instructions the traditional way is that there is always a dead line. The instructor ways says when the work is due. Also, the person instructing the lesson goes under their own pace. If the student is following behind because he or she didnt understand, they have to wait until the lesson is over. By the time the lesson is over, the pupil would have already fallen behind in many things because he was thinking about the first thing he fell behind in. By giving instructions the new way, by computerized instructions, the pupil will be able to learn at his own pace. There wont be any one to tell the pupil when the work has to be turned in. If the student happens to not understand something, he will be able to stop and go back to what they were reviewing. By computerize instruction, the learner will be able to stop at whatever time they wish and return back to the same place they left off the following day. Different Kinds Of Trial Under CRPC Law Essay Most offences in Indian criminal law were created by Statute and have a statutory maximum penalty. For the purposes of trial, offences were divided into different categories, offences triable by indictment (warrant cases) or offences triable only summarily, or offences triable either way. The most serious offences (eg: murder, rape) are triable only on indictment, at the Sessions Court. A large mass of less serious offences are triable only summarily, in magistrates courts. The middle category of offences triable either way and comprises of most burglaries, thefts and frauds. The trial is the pivotal point of a Criminal case. Sec 190 of the CrPC talks of the conditions that need to be fulfilled before proceedings can be initiated by the Magistrate (it specifically empowers a Magistrate to take cognizance of a case). It is the exclusive power of the Magistrate under Sec 204 of the CrPC to refer or reject a case from entering the stage of trial. Trial is the judicial adjudication of a persons guilt or innocence. Under the CrPC, criminal trials have been categorized into four divisions having different procedures, called Session, warrant, summons and summary trials. Sec 225-237 deal with warrant cases by a court of Session. Sec 238-250 deal with warrant cases by magistrates. Sections 251-259 provides procedure for trial of summons cases by magistrates. Sections 260-265 make provisions relating to summary trials. Warrant Case: A warrant case relates to offences punishable with death, imprisonment for life or imprisonment for a term exceeding two years. The CrPC provides for two types of procedure for the trial of warrant cases triable by a magistrate, viz., those instituted upon a police report and those instituted upon complaint or on own information of magistrate. In respect of cases instituted on police report, it provides for the magistrate to discharge the accused upon consideration of the police report and documents sent with it. In respect of the cases instituted otherwise than on police report, the magistrate hears the prosecution and takes the evidence. If there is no case, the accused is discharged. If the accused is not discharged, the magistrate holds regular trial after framing the charge, etc. Sessions case: In respect of offences punishable with death, life imprisonment or imprisonment for a term exceeding seven years, the trial is conducted in a Sessions court after being committed or forwarded to the court by a magistrate. Summons case: A summons case consists of all cases relating to offences punishable with imprisonment not exceeding two years. In respect of summons cases, there is no need to frame a charge. The court gives substance of the accusation, which is called notice, to the accused when the person appears in pursuance to the summons. The court has the power to convert a summons case into a warrant case, if the magistrate thinks that it is in the interest of justice. Summary case: The high court may empower magistrates of first class to try certain offences in a summary way. Second class magistrates can summarily try an offence only if punishable only with a fine or imprisonment for a term not exceeding six months. In a summary trial, no sentence of imprisonment for a term exceeding three months can be passed in any conviction. The particulars of the summary trial are entered in the record of the court. In every case tried summarily in which the accused does not plead guilty, the magistrate records the substance of the evidence and a judgment containing a brief statement of the reasons for the finding.  [1]   Procedure of Magistrate on appearance of accused in warrant case: In warrant case if the Magistrate finds that the charge against the accused is groundless, he has power to discharge the accused by recording reasons. If the Magistrate has reason to believe that there is ground to proceed further, he then frame charges against accused which is read and explained and thereafter asks accused whether he pleads guilty of offence or not. If the accused pleads guilty, the Magistrate may convict the accused and proceed further to question the accused about quantum of sentence. Thereafter awards sentence. If the accused pleads to be tried, the magistrate proceeds to examine the witnesses of prosecution, hearing of prosecution and examination of accused under Section 313(1)(b) CrPC follows. The accused shall also be called upon to enter defence and produce his witnesses if any. Procedure of Court of Session: In case of offence exclusively triable by a court of Session, the Magistrate may take cognizance if such an offence and commit the case to the court of Session for trial. A court of Session cannot directly take cognizance of offence triable by it. On appearance by the accused before Sessions Court, the Judge hears the public prosecutor regarding the case. If the Judge considers that there is no sufficient ground to proceed with, he can discharge the accused, otherwise he proceeds to frame charge and examines the accused about the charge. If the accused pleads guilty the judge convicts the accused and the question quantum of sentence and award sentence by way of judgment. If the accused wishes to be tried the Judge shall fix dates for examination of prosecution witnesses and shall hear prosecution arguments and then call upon accused personally to explain any circumstances against him in evidence. If no case is made-out, the Judge shall record order of acquittal. If the Judge does not think it fit to acquit the accused, he shall thereupon ask the accused to enter on his defence. Accused can also file written statement explaining the circumstances of his involvement in the case. On hearing prosecution and accused, the Judge shall give a judgment. In case the accused is convicted, he shall be heard about quantum of sentence. Thereupon award of sentence follows. Examination of Court Witnesses:-The court has power to examine any person, at any stage, as court witness in the ends of Justice. Summons procedure:-In summons case, the accused is issued summons to appear or brought before the Magistrate. Then particulars of offence are stated and if the accused pleads guilty, he is convicted or otherwise trial follows. It shall not be necessary to frame charges in summons case. Summary and trial procedure:-Summary trial is a short-cut procedure of regular trial. Since risk is involved in short cut procedure, senior and experienced judicial officers are empowered to try certain petty cases. Though some offences under this summary trial procedure involved are warrant cases, but the involvement of punishment in summary trial being only three months imprisonment, summons case procedure is followed at the trial. In this summary trial, the Magistrate shall record substance if evidence and a judgment of brief statement of reasons for the finding follows if the accused does not plead guilty.  [2]   Guidelines: The purpose of these guidelines is to help magistrates decide whether or not to commit either way offences for trial in the Sessions Court. Their object us to provide guidance not direction. They are not meant to impinge upon a magistrates duty to consider each case individually and on its own particular facts. These guidelines apply to all defendants aged 18 and above. General Mode of Trial Considerations: When deciding whether a case is better triable as a Sessions case or a warrant case, a magistrate must keep in mind the following considerations: a) the nature of the case, b) whether the circumstances make the offence one of a serious character, c) whether the punishment which a magistrates court would have the power to inflict for it would be adequate, d) any other circumstances which appear to the court to make it suitable for the offence to be tried in one way rather than the other, e) any representations made by the prosecution or the defence. Some more observations: a) the court should never make its decision only on the grounds of convenience or expedition, b) the court should assume for the purposes of deciding the mode of trial that the prosecution version of the facts is correct, c) where cases involve complex questions of fact or difficult questions of law, including difficult issues of disclosure of sensitive material he court should consider committal for trial, e) in general, except where otherwise stated, either-way offences should be tried summarily. Problems and Suggested Reforms in Trial Procedure In cases of conviction, the sentence that may be passed is limited by (a) the procedure adopted for purposes of trial: and (b) the limits placed by S.29 Cr.P.C. on different classes of Magistrates. If the case is tried by the Chief Judicial Magistrate (or the Chief Metropolitan Magistrate), the upper limit of sentencing would be any sentence authorized by law, except a sentence of imprisonment for life or of imprisonment for a term exceeding seven years. A Magistrate of the First Class (or a Metropolitan Magistrate) may pass a sentence of imprisonment for a term not exceeding three years, or of fine not exceeding Rs.5000 or of both.  [3]   The procedure for recording evidence varies according to the form of trial. Section 274 Cr.P.C., prescribes that in summons cases and inquiries, the Magistrate shall, as the examination of each witness proceeds, make a memorandum of the substance of the evidence in the language of the Court. The proviso enables the Magistrate to cause such memorandum to be made in writing or from his dictation in open Court where the Magistrate is unable to make such memorandum himself and records reasons for his inability. S.376 (d)., provides that no appeal from a convicted person shall lie when a sentence of fine only is passed not exceeding Rs.200/- in a case tried summarily by the Magistrate empowered under section 260. S.260 and 355 are either unutilized or under-utilized. Only those Magistrates (Other than CJMs and MMs) who are duly empowered, either by name, or by virtue of office, or under the statute creating the offence can try the cases summarily. But most of the Magistrates are not empowered. This is one among the many reasons why summary procedures is not fully utilized. As the Judge of the same status can deal with the case summarily when he is posted as a metropolitan Judge without any empowerment there is no reason why such empowerment is needed for other magistrates to deal with the cases summarily under Section 262 of the Code The Law Commission has in its 154th report also recommended enhancement of the limit of Sentence prescribed in Section 262 of the Code to three years. It has also recommended some incidental amendments to Sections 2(x) and 2(w). The researcher feels that Section 2(x) defining warrant case be amended by substituting the word three for the word two. Consequently all cases which are not warrant cases, relating to offences punishable with imprisonment lower than three years shall become Summons cases which shall be tried by following the summary procedure prescribed in Chapter XXI of the Code. Large number of cases which do not involve serious offences can be disposed of expeditiously. As the Magistrate has power under S. 260(2) to try the case regularly if he feels that it is desirable to do so in the interest of justice no prejudice would be caused. However, the researcher is of the opinion that proper training should be given to all the Magistrates about trying the cases following the summary procedure. The training should include mock trails and writing of judgments in summary trials by the trainees.

The Sonnet Explore aspects of the sonnet tradition through reference to a range of material you have studied The word ‘sonnet’ comes from the Italian word ‘sonnetto’ meaning little sound or song. A sonnet is a special type of poem. The sonnet is always 14 lines long and usually expresses the poets’ personal feelings or thoughts; most often connected with love or death, which are two of the most basic aspects of human existence. The poem generally uses rhyme and metre to organise the poet’s ideas in a formal way. There are several different types of sonnets which all accomplish this in a slightly different style. The Italian or Petrarchan sonnet was originally developed around 1350 by Petrarch, an Italian poet (1304-1374). Petrarch had fallen madly in love with a woman named Laura, but she was a married woman and refused to become his mistress. Petrarch wrote poetry expressing the idea of courtly love and conveying his own misery and his slavery to the love of Laura; a love denied. His verses contain accusations about the fickleness of love, the timeless quality of art and the hopelessness and devotion of eternal love. The Italian sonnet is divided into two sections by two different groups of rhyming sounds. The first eight lines are called the octave. This has two four line units that rhyme in the same way. A b b a, a b b a. The remaining six lines are called the sestet and can have either two or three rhyming sounds arranged in a variety of ways: cdcdcd, cddcdc, cdecde, cdeced, or cdcedc. The poem is clearly divided into two sections by the two differing rhyme groups. The change from one rhyme group to another signifies a change in subject matter. It was originally a formal love ‘song’ with high ideals and a rigid format. Shakespeare transformed it and made the sonnet more accessible and fun for the common man to enjoy. The sonnet has since evolved further and can be used in a wide variety of forms and for an even wider range of subject matter and can be easily read by audiences world-wide.

But is a risk at the same time because depending basically on a very limited amount of product and services it does not open many alternatives to explore new markets or develop innovative solutions amount the products and services. Even though Dell is considered a very successful business model, the company has been having problems. These problems are reflected in financial reports which indicate that Dell is not reaching the rate of growing that they were expecting. Although Internet is the base of its success, it has been a big problem for Dell as well, since the point of view that important bloggers has been complaining in the net about the pour quality of services and this has spread quickly between users a non god image of the company. Natural Science Essay

The relevance of this test question is to determine which brand of leading paper towels is the best most absorbent. Consumers want to use the product that is most effective at meeting their needs. A more expensive product may actually be more cost effective if you can use less of it than a brand that costs less. Literature Review Many experiments have been conducted to test the strength and absorbency of paper towels. While the steps of the experiment vary from test to test, all of experiments are testing the same two factors; how much water can each paper towel brand absorb and how strong are each of the paper towels. Below I have reviewed the process and results from three experiments that are similar to the one I will be using. In the first experiment, the tester uses five brands of paper towels to test for absorbency, using paper towels of the same size to ensure the accuracy of the results. He draws a two inch circle in the center of a sheet of paper towel from each brand represented and placing the paper towel in an embroidery hoop to maintain stability. He then drops fifteen drops of water into the center of the circle draw on the paper towel, repeating the process for each brand, and measures the amount of time it takes the paper towel to wick the moisture outside of the circle. This test concludes that Bounty has the greatest absorbency. The next experiment tests for both absorbency and strength. As in the first test, several different brands of paper towels were used. In this experiment, to test the absorbency, the tester takes a sheet of each of the towels an inserts it into a glass with two ounces of water and leaves each sit for twenty seconds. After the twenty seconds expired, the tester removed the paper towel from the glass and rang out each paper towel into a measuring cup to see how much water each towel had absorbed. The second part of the experiment is conducted by stretching sheets of each paper towel through an embroidery hoop, placing 25 pennies in the center of the paper towel, and adding water to the towel drop by drop until the pennies fall through. The strongest paper towel in this test was Brawny Brand. The final experiment that I reviewed also tested for absorbency. The theory behind this experiment was the faster that water moves through the towel, the more absorbent it is. The experimenter cut strips from each paper towel, one inch wide and six inches long. A mark is drawn on each paper towel one inch from the end using a waterproof marker. The strip is then held in a glass of water with the bottom inch submerged, timing how long it takes for the water to travel the length of the strip. The process is then repeated for each brand that is being tested. The most absorbent brand in this test was Brawny. Experimental Design A. Steps in Experimental Procedure The absorbency of the towels will be tested by the speed the water moves through the paper towels, the faster the water moves, the more absorbent the towel is. I will be using the following brands of paper towels in my experiment: Brawny, Bounty, Sparkle and Scott. Other supplies necessary to complete the experiment are: a waterproof marker, and a sixteen-ounce glass of water, and a timer that registers tenths of a second. 1. Prepare three samples of paper towel from each brand by cutting strips of each that is 2 inches wide and six inches long. 2. Using a water-proof marker, draw a line across each paper towel one inch from the bottom. 3. Fill a sixteen ounce glass with water and prepare timer. 4. Take the first strip of paper towel and submerge it up to the line in the glass of water while holding it vertical to the glass while starting the timer. 5. Allow the timer to run until the water is absorbed through the paper towel and reaches the end of the towel not submerged. 6. Stop the timer and record the time in tenths of seconds. 7. Repeat steps 4 through 6 for all three strips of each brand. B. Reasoning for Choosing my Experimental Design Plan The reason I chose this design for my experiment is because it seemed to be more accurate than other testing methods I found during my literature review and could be performed with items I already had in my home. The experiment where the tester rang out the paper towels and measure the water that they had absorbed is less accurate because there is no guarantee of exerting the same amount of force each time you ring out a towel. There is no way to completely drain the towel of all of the liquid it absorbed. Stretching the paper towel samples across the embroidery frame is sound way to perform the experiment but it would have required the purchase of additional materials. C. Sequence of Events to Collect Quantitative Data I will begin the collection of quantitative data by cutting the paper towel samples from each brand into strips that are one inch wide by six inches long, to ensure that all of the samples will be equal. I will use the same glass of water for each test to ensure the water composition is the same for each test. I have created a spreadsheet in excel with a column listing each of the brands being tested and three columns for the time in tenths of a second to be entered upon completion of the experiment. During the experiment, I will make notes on a tablet of the brand name and the time recorded to be entered into the spreadsheet upon completion of the entire experiment. D. Describe Tools, Technologies, and Measurement Units that are used to Collect the Data To collect the data for this experiment I will use one inch wide by six inch long strips of paper towel from each of the brands being tested, a black water-proof marker to mark the strips of paper towel, an eight ounce glass of water, my hand to hold the strip vertical to the glass once submerged as indicated in the experimental procedure, a timer that measures tenths of a second, and a pad and pencil to record the initial results. Once the experiment is complete I will transfer the results of the experiments to the spreadsheet that I have created using Microsoft Excel. I will also use excel to create the graphic representation of the experiment results. Dependent, Independent and Controlled Variables of the Experiment The independent variable in my paper towel experiment is the one inch by six inch strip of paper towel taken from a roll of each brand of paper towel used in the experiment. The dependent variable in the experiment is the amount of time it takes the water to travel the length of the strip of paper towel measured in tenths of a second. The controlled variables of the experiment are using the same glass of water, same size sample of paper towel, and same timer for each test in the experiment. Threat Reduction to Internal Validity To reduce internal threats to validity I will use the same size piece of each paper towel from each brand for each test to conduct the experiment, marking each piece with a line at exactly one inch from the bottom. I will use the same water sample to ensure the liquid being absorbed by each sample strip is identical; the same timer will be used for each test to ensure the accuracy of the time recorded for each test. I will also monitor my results for outliers in the time required to absorb the water through each test towel to ensure the results are valid for each test. Hypothesis The sample of Bounty paper towels will soak up the water through the length of paper towel faster than the other brands because it is thicker than the other brands being tested. I have arrived at this conclusion because the dual layers of towel that are present in the sample of Bounty create a greater surface to absorb water. The other brands are much thinner and have less thickness to soak up water.

After an initial slow start at the expected role of child-bearer- her husband apparently had to be coached in his role in this- Marie Antoinette gave birth to her first child, a daughter, in 1778, and sons in 1781 and 1785. Marie Antoinette and the French Revolution After the Bastille was stormed on July 14, 1789, the queen urged the king to resist the Assemblys reforms, making her even more unpopular and leading to the unproven attribution to her of the remark, Quils mangent de la brioche!- often translated as Let them eat cake! The phrase was actually first seen in print in Jean-Jacques Rousseaus The Confessions, written before Marie Antoinette was queen. In October 1789, the royal couple was forced to move from Versailles to Paris. Two years later, the attempted escape of the royal couple from Paris was stopped at Varennes on October 21, 1791. This failed escape was reportedly planned by Marie Antoinette. Imprisoned with the king, Marie Antoinette continued to plot. She hoped for foreign intervention to end the revolution and free the royal family. She urged her brother, the Holy Roman Emperor Leopold II, to intervene, and she supported a French declaration of war against Austria in April 1792, which she hoped would result in the defeat of France. Her unpopularity helped lead to the overthrow of the monarchy when Parisians stormed the Tuileries Palace on August 10, 1792, followed by the establishment of the First French Republic in September. The family was imprisoned in the Temple on August 13, 1792, and moved to the Conciergerie on August 1, 1793. The family made several attempts to escape, but all failed. Death Louis XVI was executed in January 1793, and Marie Antoinette was executed by the guillotine on October 16 of that year. She was charged with aiding the enemy and inciting civil war. Legacy The role Marie Antoinette played in French governmental affairs, both domestic and foreign, was likely greatly exaggerated. She was particularly disappointing to her brother, the Holy Roman Emperor, for her inability to further Austrian interests in France. Her lavish spending, furthermore, did not significantly contribute to Frances economic troubles before the revolution. Marie Antoinette, however, remains an enduring symbol, around the world and across history, of the extravagance of monarchy and aristocracy- against which revolutionaries define their ideals.
